Mark Shuttleworth (Mr. Ubuntu) risponde a Roy Schestowitz (BoycottNovell) chiarendo la sua posizione riguardo ai brevetti software ed in particolare alla questione Mono:

At this stage we see no significant issues with patents and Mono.
There is a risk of a patent claim against almost any component of
Ubuntu – across every jurisdiction in which Ubuntu ships, the patent
minefield is too complex. Our view is that we can deal with patent
suits if they arise, but removing or re-engineering the relevant
components.
Yesterday’s
announcement from Microsoft suggests that they have come round to the
view that patent litigation is not an effective strategy for them.
The real patent risk to free software, in my view, is not a
large-scale industry participant like SONY or IBM or Microsoft, instead
it is a small, hard-to-identify patent holder who does not actually
need to get products out the door. We cannot live in fear of that
threat, we can only respond to it as an when it arises.
I don’t mean to undermine the good work that you do in reminding
people of the risks, but only to say that we have discussed this in
Ubuntu and are confident that the course we are on is a reasonable one.

In questo momento noi non vediamo particolari problemi legati ai brevetti e a Mono. C’è un rischio di rivendicazione di brevetti per quasi tutti i componenti di Ubuntu – prendendo in considerazione ogni giurisdizione nella quale Ubuntu viene distribuita, il campo minato dei brevetti è troppo complesso. Il nostro punto di vista è che possiamo affrontare le eventuali azioni legali per brevetti se si presentano, ma rimuovendo o riscrivendo i componenti incriminati.
L’annuncio di ieri da Microsoft suggerisce che siano giunti alla conclusione che la disputa sui brevetti non è una strategia vincente per loro.
Il reale rischio brevetti per il software libero, a mio avviso, non viene dai grossi nomi dell’industria come SONY, o IBM o Microsoft, ma dalle piccole entità, difficili da identificare,che detengono i brevetti, ma che non sono interessate alla diffusione dei propri prodotti. Non possiamo vivere nel terrore di questa minaccia, possiamo solo rispondere se e quando si presenterà.
Io non intendo minare il buon lavoro che stai facendo ricordando alla gente i rischi, voglio solo dire che ne abbiamo già discusso in Ubuntu e siamo sicuri che la strada intrapresa sia ragionevolmente sicura.
Personalmente sono totalmente d’accordo con Mark, non ho mai fomentato i FUD anti Mono proprio per questo motivo, sono anzi convinto che sia tutto tempo sprecato stare a preoccuparsi ora di eventuali futuri reclami.
Vi lascio riflettere sulle parole di Mark nel frattempo preparo una descrizione del MIO punto di vista sulla questione.
